the mid-80s. pretty mild and nice. lower 60s around the bay a little chilly and along the coastline essentially the upper 50s. conditions will be cool for the coast and mild inland saturday, sunday, monday, tuesday, wednesday and right now looks like we could see, i am hedging, could see warmer conditions around the bay. >> thank you, tracy. back to you. >> we'll wait and see. thank you very much. it is 6:03. a sophisticated pot growing operation uncovered in the east bay. let's go to anne makovec. she is in oakland to explain that police, what, anne, actually went there because they got a burglary call? >> reporter: yeah. it turned out to be not what they expected. really it's an unassuming building here on east 12th street in oakland. a restaurant on the bottom and they were called to a burglary here and found a pot farm on the top of the building according to police. a sophisticated one. here's a look at the scene at around midnight last night.

police initially came because at the got a call of a burglary in progress -- they got a call of a burglary in progress. one man jumped over a fence, the other tried to hide on the roof. he was hunted down by a police dog. that dog actually bit the man. police called an ambulance just in case. but the man appeared to be fine just busted obviously. here's what one suspect says he was up to before police put him in the back of the car. >> i was at the park smoke a cigarette on the phone my female was going to come get plea and then his partner just slammed me and said what i'm doing i said [ bleep ] talking to my girlfriend. that's what happened. >> reporter: when police entered the second floor of the building they say they found over 120 pot plants and a large amount of dried marijuana as well plus a lot of equipment, lighting and complicated ventilation system in and out of the building. in fact, i spoke with a passerby this morning and she

said she did often smell marijuana outside of this building. police initially called to a burglary they ended up with a pot bust. they were able to remove all the pot but not all of the equipment becauseof a lack of manpower. >> i'm sure it will come out soon. thank you, anne makovec in oakland this morning. today the two sides in the proposition 8 case are ordered to submit briefs concerning a stay on same-sex marriages. federal judge vaughn walker issuing a temporary stay on weddings wednesday when he ruled prop 8 was unconstitutional. the issue now whether to continue that stay while the ruling is being appealed. the temporary stay means no gay or lesbian marriages in california at least until judge walker rules on the briefs that will be filed today. san francisco city attorney dennis herrera is taking action against two local gangs. he is seeking an unjunction against members of the down below and tower side gangs,

whose bitter rivalry has terrorized visitacion valley. meantime dozens of suspected gang members have been arrested in sweeps across the east bay. 30 different agencies have teamed up for what they call operation gangbusters. more than 100 officers are searching for parole violators and suspected gang members. >> the sweep yielded 48 total arrests, 37 on parole, and 11 on probation. two firearms, 106 marijuana plants, approximately $5,000. two machetes. four parolees are at large. >> the department of corrections announced plans to play more than 800 known gang members on gps. and they also plan to hold more sweeps in the bay area. a man and a woman are under arrest in connection with the vallejo courthouse arson. a search warrant led to the arrests of octavia walton and benjamin stickle both from vallejo. stickle was already in custody

on unrelated charges. the suspicious three-alarm fire happened back in june. that damage mainly centered in the court's criminal division offices and destroyed thousands of court records and files in the clerk's office. out with the old transbay terminal, in with the new. the terminal will close for good after midnight tonight so construction can begin on the new transbay transit center. that original terminal opened in 1993. it's become a spot though where more than 100 homeless people sleep each night to get out of the cold. people though have complained for years that it needed to be replaced. in its place, the new temporary transbay terminal opens tomorrow. it's at howard and main streets just ablock or two away. the $18 million terminal will operate for the next 7 years while the permanent terminal is built. 6:07. san francisco trying out a new pilot program to help muni

riders feel safe. community ambassadors are now stepping in because of the high number of crimes committed at or near muni stations. it runs like a buddy system. a dozen city employees are now posted at stations in areas of the city that have struggled with violent crime. >> people will feel less vulnerable and when they look around them, they will see young people, older people, and they will see people of every ethnicity there to make them feel safer and less vulnerable. >> the board of supervisors has already moved to toughen penalties for crimes that happen in or around muni stops. carrying a concealed weapon or aggressively harassing someone could lead to a $1,000 fine. it is 6:08. this could cement the deal. we'll tell you what bp plans to do next in the battle to plug that gulf oil leak for good. plus, an age bias case against google. what the state supreme court has to say about it. today they're waiting for

very much. it's 6. 11. today we are waiting for cement to dry in the broken oil well in the gulf of mexico. that cement was pumped on top of heavy mud that sealed the well earlier this week. that process is static kill. the next step is the bottom kill when crews will pump cement into the relief well to make sure the well is sealed for good. meanwhile, louisiana officials will re-open the shrimp season in most areas about 10 days from now. but they say they are going to delay the oyster season by about 2 months. elena kagan will be sworn in tomorrow as the next united states supreme court justice. today kagan will be at the white house to celebrate yesterday's senate vote to confirm her. five republicans joined all but one democrat to support kagan. she will be the nation's 112th justice and the fourth woman to serve on the court. she will replace retired justice john paul stevens when the court begins its new term october 1. the california supreme court has cleared the way for

an age discrimination lawsuit against google to move forward. this case involves that man, brian reed. he is an engineer in his 50s. he says the mountain view-based internet giant fired him because he wasn't a good cultural fit with his younger colleagues. an appeals court in san jose previously concluded that reed is entitled to bring the case to a jury trial. yesterday, the california supreme court agreed. google says it fired reed because of poor performance. the case could determine the amount of evidence needed for age bias lawsuits. 6:13. let the sun shine in! coming up next, a san jose company unveils a major solar project. tell you how much energy and money it will save. how much sunshine in the bay area today? we are starting things off with plenty of clouds, drizzle for the coast and the bay. for the afternoon, sunshine expected for some areas and pretty mild temperatures. we have your afternoon highs and your forecast for the weekend coming up.

good morning. we have a couple of problem spots across the bay area. check out this traffic heading up the incline of the upper deck of the bay bridge. there was an accident at the top of the incline. we may see a few flashlights

right there. it's either an accident or stall with another car behind t bridge crews are heading to the scene now but in the meantime you can see it is slow going as you make your way up the upper deck. looks better actually once you get closer to the "s" curve and on the san francisco side of the bridge. no metering lights yet. and in fact behind the pay gates no wait at all so this is your only slow spot right now. but it sounds like that either accident or stall is blocking at least one lane. so we'll let you know when that clears and exactly what is going on in the next traffic hit. in the meantime we have a new issue in richmond, as well. it sounds like they have closed the on-ramp from 23rd out to eastbound 580. there was an overturned car involved in this accident. chp and ambulance are heading to the scene now so at least minor injuries involved in that crash. if you are continuing towards the richmond/san rafael bridge, on westbound 580, this actually looks great. overall we have had friday light traffic for most of the morning commute so far. it's still early but so far we haven't seen any big issues out there. this is westbound 580 traffic

two men are under arrest for a burglary on east 12th street in oakland early this morning. there could be more arrests since the burglary was at what may be an illegal marijuana growing operation. and the old transbay terminal will close for good at midnight to make way for construction of a new one. tomorrow, this, a temporary terminal in san francisco will be the new drop-off point for a.c. transit riders from the east bay into the city. the original terminal opened way back in 1939. san jose city leaders are showing off the city's newest and largest solar installation. a giant solar panel was installed at power integration a company that provides energy- efficient power for a variety of electronics. the installation is made up of, get this, 2500 panels and cover an entire parking lot. the system is expected to cut more than 10,000 tons of greenhouse gas emissions over the next 25 years. it will also save the company

here's a wonderful picture taken at the legion of honor. san francisco mix of sun and clouds, the daytime high of 61 degrees. 62 in berkeley with similar conditions. 78 in san ramon, sunny skies, 85 in antioch, mostly sunny skies. we'll take a look at your weekend forecast coming up. tracy, thanks very much. beaver update! i don't say it like john kessler. that's why he is with his mother trying to get a little retraining here. it's beaver fever in martinez. tomorrow is the third annual beaver festival. they started a beaver festival because of those little guys. it's an event to celebrate the family of beavers living in alhambra creek in downtown. this year's festival will run

from 11:00 a.m. to 4:00 p.m. in beaver park. the beavers created a lot of controversy when people living near the creek were afraid that the dams built by the beavers would create flooding. but the city decided to let them live there. they have become a tourist attraction. and so they had a device that was built to prevent the beavis from adding height to their dam. the beaver deceiver. it hasn't felt much like summer in the bay area this week but that's not the case in most country. people in this texas town packing into the pool to beat the heat. that wasn't enough to cool them off, though, look what happened. they are dumping a ton of crushed ice in the water! there were heat advisories in 18 states yesterday. not even nightfall brought relief for those folks. temperatures in some states, get this, in the 80s overnight. the summer weather in the bay area, it is certainly a lot

toes" day good morning. welcome back. i'm sydnie kohara. john kessler is on vacation. it is 6:31. it is national wiggle your toes today but it might be a little chilly for some of you in san francisco and the coast. we'll have the weather coming up but first let's get going to work with elizabeth wenger. >> time to break out the flip- flops for wiggle your toe day. most of our freeways look good. we still have a problem at richmond on-ramp 23rd and eastbound 580 closed. there was an accident involving an overturned car and an ambulance is on the scene so injuries involved. we are not sure how long it's going to be closed but it's been closed for 15 minutes. the main lines to 580 look okay

towards the richmond/san rafael bridge. westbound 580 closer to the dublin interchange. this actually looks good. usually around this time of the morning we see a few more yellow on our sensors here but it's still holding steady about 15 minutes from the altamont pass out towards 680. and actually continues to move well towards castro valley. all your approaches to the bay bridge, fine. you can see a little bit of slow traffic though up the incline. got an earlier stall cleared from lanes. no metering lights. that is your traffic. for your forecast, here's tracy. >> hey, thanks, elizabeth. forecast this morning, here we go! mount vaca, we found some sunshine. those of you who answered our question of the day, i haven't seen the sun in days, here's a little bit of sunshine. that's all we'll get for the coast and bay today. they will see more around the bay but for the coastline today, plenty of clouds expected. daytime highs essentially mimicking the fact that you will have plenty of clouds. look at that. temperatures in the 50s in pacifica, 60 degrees in san francisco. 64 in oakland with a mix of sun and clouds.

aren't? >> yeah, it's a restaurant on the bottom but according to police the top floor was a sophisticated pot farm. early this morning, police initially came to the building because they got a cal of a burglary going on and they saw two men running out of the back of the building. one of them jumped across the fence. another man ran to the roof. a police dog found him and bit him. police called an ambulance just in case. but he appeared to be fine, just busted obviously. when police entered the second floor, they say they found over 120 pot plants and a large amount of dried marijuana plus a lot of equipment, lighting and a complicated ventilation system in and out of the building. one woman said she smelled a pot-like smell coming out of the building. police were able to clear the

happened back in june. the damage mainly centered in the court's criminal division offices. and it destroyed thousands of court records in the clerk's office. 6:37. the killer who went on a shooting rampage in connecticut says racism drove him to do it. >> you probably want to know the reason why i shot this place up. this is a racist place. >> yup, i understand that. >> that's the voice of omar thornton who called 911 on tuesday after he shot ten coworkers killing eight of them. the officer offered thornton a safeway out but he refused. >> where in the building are you, omar? >> i'm not going to tell you that. when they find me, that's when everything will be over.

thornton and the company >> thornton was found dead in the beer distribution warehouse. thornton's union and the company said he never filed a complaint over racism and was fired for stealing beer and selling it. it is a new pilot program designed to keep muni riders safe. community ambassadors, they are now stepping in because of the high number of crimes committed at or near bus and train stations. joe vazquez went to san francisco to show us how this new buddy system works. reporter: wearing a bright green vest and armed with just a cell phone, 12 community ambassadors are now stationed at bus and train stops in areas of the city that have struggled with violent crime. >> people will feel less vulnerable, and when they look around them they will see young people and older people. they are to make them feel safer and less vulnerable. >> reporter: back in march, a surveillance camera captured this harrowing assault of a female passenger. a group of young men grabbed the woman and wrestled her down to the tracks below. the woman survived but the

attack set off a series of community meetings which led to this piloted program of community ambassadors. they are not going to escort you home. they will simply patrol the areas around bus and train stops and ride the trains to act as deterrents to crime. the ambassadors are city employees assigned to the visitacion valley and bayview districts along the t line and nine san bruno routes. >> just like in the old day people would do that normally, walk around their neighborhood and keep an eye open, it's the same type of thing. he think it's a good idea. >> reporter: police say about 100 crimes a month including robberies and stabbing, happen on or near muni stops. the hope is the very presence of these unarmed ambassadors will deter criminals and if they see something bad happening, they are to call for help but not necessarily get in the middle of it. >> i do feel a lot more safe a lot more comfortable and it does take ease off of, you know, where i'm going especially with the environment that we're around but say if get in a fight right now or somebody starts to rob my purse and they're standing there i'm going to want them to do

something about it. >> they ain't gonna scare them away. people still gonna do what they want to do. it really don't matter. >> reporter: joe vazquez, cbs 5. >> make it will make them think twice about it, though. out with the old transbay terminal in with the enough. the terminal will close for good at midnight tonight so construction can begin on the new transbay transit center. the original terminal opened in 1939. it has become a spot where more than 100 homeless people sleep each night. people have complained for years that it needed to be replaced. and in its place, this, the new temporary transbay terminal. it opens tomorrow. this facility is located at howard and main streets. the $18 million terminal will operate for the next seven years while the permanent terminal is built. the new clipper cards are supposed to make public transportation more convenient in the bay area. but we have received e-mails including one from phillip in san francisco that says that's not the case. he prepays for his clipper card

to have unlimited use on 16 muni buses and bart. he says that he had to pay full fare for the first few days of the month because the prepayment wasn't deducted from his paycheck on time. the metropolitan transportation commission, though a apologizes for the problem. the agency believes it's not widespread given the system processes up to 2 million transactions a month. work begins monday morning on a project to make the highway 24 commute easier in the east bay. caltrans will start digging that fourth bore for the caldecott tunnel through the oakland hills. you see all the preparation works that's been going on the last couple 6 months. they are going to use a $5 million machine called a road header to dig the two-lane tunnel. it will be nearly 3400 feet long. it's expected to take more than three years to dig. they will have a ceremony monday before firing up the road header. 6:41. the latest unemployment figures out this morning. we'll have a financial update

out to 880 in oakland a lot of fridays we see light traffic today no exception. it's quiet. here's a live look at 880 through oakland past the coliseum moving fine into downtown. richmond trying to access eastbound 580 using the 23rd street on-ramp, it's closed and has been for a while after an overturn injury accident there. out of downtown san jose though fine in the northbound lanes of 280 and the bay bridge even despite an earlier stall on the incline, traffic is great at the pay gates and still no metering lights by the way. so easy ride into san francisco. it is hi-5 time. today's hi-5 is in san jose we are out at the fairgrounds and we have the young people of future farmers of america and 4h. i think we'll have a picture of them. there they are. giving us a big hi-5 wave. they have been planning for this weekend, santa clara county youth fair. and there is actually going to be a junior livestock auction featuring 150 animals including some of the let's see there's goats, lambs,

petaluma and santa rosa, the lower 70s. seven-day forecast, so we are heading into the weekend. it's friday, don't you love it? friday forecast, cool for the coast, mild inland, no major changes expected in our forecast until the end of next week. we do have some models indicating we could see more seasonal temperatures, warmer weather moving into the bay area. so we'll have to keep our eye on that. that's a look at your weather. back up to you. >> thank you. i like it tracy. it's 6:48. the experts expected the nation's jobless rate to climb a little last month but it didn't. let's go to jason brooks with kcbs and cbsmoneywatch.com. i'm certain that news is probably affecting the stock market. >> reporter: that is the big driver for wall street this morning. the july jobs report. it's the most thorough look at the employment situation which is the biggest key right now in the economy. and while the unemployment rate stayed even at 9.5%, overall we lost 131,000 jobs from the economy. now, that was mainly due to a

loss of a couple hundred thousand government jobs the majority temporary census work that stopped. that was expected. the overall number offset by the fact private employers hired 71,000 new workers, not bad but a little under expectations. and the reason why the unemployment rate stayed even, another 181,000 people simply stopped looking for work. that's a continued worry. if there is one glimmer of hope in the report that might be helping the markets a little bit, it's that the average workweek increased a little bit. that's a sign that employers are seeing increased demand for their products or services. they need the workers to work a little longer. they might have to hire new workers rather than paying overtime to their currently stressed-out workers. let's see how it's reacting on walling street. down 45. nasdaq down 11. s&p down by five on wall street. not that bad considering the report overall wasn't what was

case today. a federal judge ordering them to file briefs concerning his temporary stay on same-sex weddings and then he will decide whether to extend the stay through the appeals process. a burglary case and drug case all in one. oakland police arresting two men on east 12th street this morning. police say the burglary target was an illegal and sophisticated pot growing operation. tomorrow a temporary terminal will be the new drop- off point for a.c. transit riders from the east bay to san francisco. the original terminal opened back in 1939 and it is closing for a new terminal. we found some slow traffic in san jose. northbound 280 just before winchester boulevard. a five-car accident was recovered and immediately moved to the right shoulder but there is still activity there. chp on scene so you can see all that slow traffic right now heading out of downtown.
